
Federal Judge Dismisses Criminal Cases Against Comey, James
A federal judge on Monday invalidated criminal charges against former FBI Director James Comey and New York Attorney General Letitia James, ruling that the prosecutor overseeing their respective cases had been unlawfully appointed. The significant decision marks a legal victory for both prominent figures, who have consistently maintained their innocence and alleged political targeting.
U.S. District Judge Cameron McGowan Currie, in a detailed written opinion, concluded that Lindsey Halligan, who had been designated as the interim U.S. attorney for the Eastern District of Virginia by then-President Trump in September, lacked the proper legal authority to pursue the indictments. “I conclude that the attorney general’s attempt to install Ms Halligan as Interim US attorney for the eastern district of Virginia was invalid and that Ms Halligan has been unlawfully serving in that role since September 22, 2025,” wrote Judge Currie, an appointee of former President Bill Clinton.
Judicial Ruling Cites Unlawful Appointment
Judge Currie’s ruling further stipulated that “all actions flowing from Ms Halligan’s defective appointment” were “unlawful exercises of executive power and must be set aside.” This finding effectively nullifies the legal foundation upon which the prosecutions of Comey and James were built, leading to their immediate dismissal.
The charges against James Comey stemmed from allegations of lying to Congress, dating back five years. Letitia James, on the other hand, faced accusations of mortgage fraud. Both individuals had vehemently denied any wrongdoing since the onset of their legal battles, characterizing the cases as politically motivated attempts by the Trump administration to retaliate against perceived adversaries.
Defendants Allege Political Targeting
Following the court’s decision, both Comey and James issued statements expressing relief and reiterating their belief that the charges were a “thinly veiled effort” to punish them for their opposition to Donald Trump. The ruling provides a powerful affirmation of their long-held stance.
Letitia James released a statement conveying her gratitude and resolve. “I am heartened by today’s victory and grateful for the prayers and support I have received from around the country,” James said. She further asserted her unwavering commitment to her public duties: “I remain fearless in the face of these baseless charges as I continue fighting for New Yorkers every single day.”
James Comey also lauded the court’s intervention in a recorded video message. “I’m grateful that the court ended the case against me which was a prosecution based on malevolence and incompetence,” he stated. Comey emphasized the broader implications of the ruling, particularly regarding the separation of powers and the integrity of the justice system. “This case mattered to me personally, obviously, but it matters most because a message has to be sent that the president of the United States cannot use the Department of Justice to target his political enemies.”
