Federal Judge Allows Khalil Free Travel Amid Deportation Fight
A federal judge has granted Palestinian activist Mahmoud Khalil the freedom to travel throughout the United States, removing previous restrictions that confined his movement. This pivotal ruling enables Khalil to participate in rallies and other public engagements nationwide as he continues to challenge the Trump administration’s efforts to deport him.
Khalil, a legal US permanent resident and green card holder, was released from an immigration detention facility in Louisiana in June. His arrest by Immigration and Customs Enforcement (ICE) occurred amidst a series of roundups targeting students and activists. Previously, a federal magistrate judge had limited his travel to specific states: New York, New Jersey, Washington D.C., Louisiana, and Michigan. Khalil had sought to have these limitations rescinded.
Legal Arguments Unfold in Virtual Hearing
During a virtual hearing held on Thursday, Alina Das, legal counsel for Khalil, emphasized the constitutional underpinnings of her client’s request. Khalil, a former Columbia University graduate student who received a deportation order last month, “wants to travel for the very significant first amendment reasons that are at the bottom of this case,” Das stated. She further articulated Khalil’s desire to “speak to issues of public concern,” underscoring his fundamental right to free speech.
Conversely, Aniello DeSimone, representing the government, which opposed the lifting of restrictions, argued that Khalil “has not provided enough of a reason why he couldn’t attend these and other events telephonically.” The government’s stance suggested that remote participation could adequately serve Khalil’s purpose without requiring broader physical movement.
Judge Sides with Khalil on Travel Freedom
Magistrate Judge Michael Hammer ultimately sided with Khalil, agreeing to permit him unrestricted travel. Judge Hammer’s decision was based on his assessment that Khalil did not pose a flight risk and had not violated any of the conditions previously set for his release. However, Hammer did concur with the government on one point: Khalil is required to notify ICE of his travel plans.
Khalil’s initial arrest by ICE officers took place on March 8. This action followed his involvement in pro-Palestinian demonstrations at Columbia University, an elite Ivy League institution located in New York City. The Trump administration has asserted its authority to detain and deport Khalil, alleging that his presence in the United States constitutes a threat to national security. A secondary accusation against Khalil claims he omitted crucial details concerning his work history and affiliations with various organizations when submitting his application for a green card.
Continued Activism and Public Discourse
Following his release from detention, Mahmoud Khalil expressed his firm intention to continue his advocacy. He specifically mentioned plans to persist in his criticism of Columbia University, indicating his ongoing commitment to public discourse and activism. This latest judicial decision marks a significant development in his ongoing legal battle, empowering him to amplify his voice across the nation as his deportation case proceeds.
